Terms of Service

1. Acceptance

By creating an account or using bookt, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not create an account or use bookt. These Terms constitute a legally binding agreement between you and bookt LLC ("bookt," "we," "us," or "our").

2. Independent Contractor Classification

Beauty professionals listed on bookt ("Providers") are independent contractors, not employees, agents, partners, or joint venturers of bookt. bookt is a technology marketplace that connects clients with Providers; bookt does not employ Providers, set their hours, supervise or direct their work, provide their tools or supplies, or guarantee the quality or outcome of any service. The relationship between a Provider and their clients is independent of bookt. Providers are solely responsible for complying with all applicable federal, state, and local laws governing their trade, including licensing requirements in the State of Texas.

3. Platform Fees

bookt charges a platform fee of 10% on each completed booking (the "Platform Fee"). This fee is applied via Stripe Connect's application_fee_amountmechanism and is automatically deducted from the booking total before funds are transferred to the Provider's Stripe Connect account. Providers receive the net booking amount after the Platform Fee is deducted. bookt reserves the right to change the Platform Fee with 14 days' notice to active Providers.

4. Cancellation Policy

Clients may cancel a confirmed booking in accordance with each Provider's individual cancellation policy, which is displayed on the Provider's profile before booking. Cancellation deadlines and refund eligibility vary by Provider and are at the Provider's discretion. If a Provider cancels a booking for any reason, the Client will receive a full refund automatically. Repeated Provider cancellations may affect the Provider's standing on the platform.

5. Content License

By posting portfolio photos, captions, or other content to bookt ("User Content"), you grant bookt a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, and distribute that User Content on the bookt platform and in bookt's marketing materials (including social media, advertising, and press). You retain full ownership of your User Content. You represent that you have all rights necessary to grant this license and that your User Content does not infringe any third-party intellectual property rights.

6. Prohibited Conduct

You agree not to:

• Discriminate against or harass any user on the basis of race, color, religion, sex, national origin, disability, age, or any other characteristic protected by law.
• Post false, misleading, or fraudulent reviews, listings, or profile information.
• Circumvent bookt's payment system by arranging off-platform payments for bookings facilitated through bookt.
• Use automated tools, bots, or scrapers to access or collect data from bookt without authorization.
• Violate any applicable local, state, federal, or international law or regulation.

Violations of these prohibitions may result in immediate suspension or permanent termination of your account.

7. Account Termination

bookt may suspend or permanently terminate any account at any time, with or without notice, for violation of these Terms, for conduct that bookt reasonably determines to be harmful to users or the platform, or for any other reason at bookt's sole discretion. You may delete your own account at any time via Profile → Account → Delete Account in the app, or at joinbookt.com/account/delete. Deletion of your account does not affect bookt's rights to retain anonymized historical records as described in the Privacy Policy.

8. Disclaimer of Warranties

bookt provides the platform "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. bookt does not warrant the quality, safety, legality, accuracy, or completeness of any service offered by a Provider, any User Content, or any other content on the platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, bookt's total liability to you for any claim arising out of or relating to these Terms or your use of bookt is limited to the total amount you have paid bookt in the twelve (12) months immediately preceding the event giving rise to the claim. In no event will bookt be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the theory of liability and even if bookt has been advised of the possibility of such damages.

10. Binding Arbitration & Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of bookt — including claims that arose before the existence of these Terms — will be resolved exclusively through final and binding individual arbitration administered by JAMS in Houston, Texas, under JAMS's Streamlined Arbitration Rules and Procedures. You and bookt each waive any right to a jury trial. You and bookt each waive any right to participate in any class action, class arbitration, or representative proceeding. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or misuse of the platform.

11. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. For any judicial proceedings not subject to arbitration (including proceedings to confirm or enforce an arbitration award), you and bookt consent to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.

12. Age Requirement

You must be at least 16 years old to create an account or use bookt. By creating an account, you represent and warrant that you are at least 16 years of age. If bookt learns that a user is under 16, we will terminate that account and delete associated data as described in our Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email and in-app notification at least 14 days before the changes take effect. Your continued use of bookt after the effective date of the revised Terms constitutes your acceptance of those changes.
